Work permit
A work permit is a document issued by a competent authority that allows foreigners to work legally in Vietnam. The competent authority to issue work permits to foreigners fully meets the conditions prescribed by Vietnamese labor law.
Subjects granted work permits
Pursuant to Decree No. 152/2020/ND-CP on work permits for foreign workers entering Vietnam, the subjects eligible for work permits upon entering Vietnam include:
Conditions for being granted a work permit
Duration of work permit
The term of work permits is issued within the term of certain cases but must not exceed 2 years.
Renewal of work permits
The maximum term of the work permit is only 2 years, so if the external worker wants to continue working in Vietnam, he/she must renew the work permit. According to Decree No. 152/2020/ND-CP, the work permit is only renewed once and the maximum extension period is 2 years. A work permit should be renewed for a minimum of 5 days and up to 45 days before the work permit expires.
Work permit under marriage
According to the provisions of the Labor Code 2019, foreigners who marry Vietnamese and live in the territory of Vietnam fall under the case of work permit exemption, so foreigners need to carry out corresponding procedures to apply for a certificate of work permit exemption. The procedure for obtaining a work permit exemption certificate is different from the procedure for applying for a work permit, so foreign workers should pay attention to avoid confusion.
Application for work permit
1: Written request for work permit of the employer
2: Health certificates or medical examination certificates issued by competent foreign or Vietnamese health agencies or organizations are valid for a period of 12 months.
3: Judicial record cards or documents confirming that foreign workers are not persons who are serving their penalties or have not been cleared of criminal convictions or are under the period of being examined for criminal liability of foreign countries or of Vietnam.
4: Documents and documents proving that they are managers, executives, experts, technical workers and some occupations and jobs.
5: 02 color photos taken no more than 06 months up to the date of application.
6: The written approval of the need to employ foreign workers unless the need to employ foreign workers is not required..
7: Copies with passport certification are valid in accordance with the law.

Procedures for issuance of work permits

Receive a valid work permit from the Ministry of Labor, Invalids and Social Affairs or the Department of Labor, Invalids and Social Affairs in the province in which the client is expected to work.
Step 05:Hand over papers to customers
Hand over work permits and other relevant documents to customers.
